Is it legal for the government to record personal data about you and your car without your knowledge or approval?  Is it legal for the government to require a device installed on all vehicles that it can use to provide evidence against the owner in a court of law (Fifth Amendment, US Constitution)?  Is it legal for the government to use evidence from such an electronic device, after it has been put through extreme physical abuse, to possibly send the owner to the penitentiary?

All these questions are about to be settled in the US Congress, the US Courts, or, if actions such as these that continue to infringe on liberty are not stopped, in the streets.

I think it would best be settled by the consumer who refused to buy cars equipped with edrs.  However, the consortium of auto companies, insurance companies, and government "officials" have made it impossible for the consumer to buy an edr-free car by conspiring to install them on ALL vehicles.

To answer your question, it is my belief that there are no laws currently in force that would prevent an individual from destroying the edr in his own car, provided that the device was installed long BEFORE an event took place.  I believe there is a law that prevents one from disabling the safety systems in an automobile, but none to my knowledge covering the destruction of the edr, provided it was installed before the "event" (installation before the event would make it extremely difficult for the prosecution to say the edr destroyer was installed just prior to a purposeful illegal act).

If there is anyone knowledgeable about this subject on this site, I would certainly be interested in their opinion.

Privacy rights are as much a part of liberty as free expression, the right to congregate, and the right to bear arms.  Whether we choose to remain a free society, is only dependent upon ourselves.  America is never more than a generation away from destruction.
